General Terms and Privacy Policy

Agreement to the following General Terms and Privacy Policy is a condition for using the service and constitutes an agreement between Servul and you (hereinafter: "the User") for all intents and purposes.

1. Terms of Service Use

1.1. Servul provides the User with database services of the User's service providers and allows the User to document, preserve and check all of their engagement system with suppliers (hereinafter: "the Service"). The Service is provided free of charge. Servul is not responsible for any costs associated with using the Service, including mobile phone and internet network costs.

1.2. For registration to the Service, the User must provide an email and password as well as associate a phone number (hereinafter: "User Details"). The User confirms that all personal details provided to Servul are complete and accurate and were provided voluntarily and with consent, although there is no legal obligation to provide them.

1.3. User Details will be registered in Servul's database. The Subscriber must notify the company, within a reasonable time, of any change or addition to the details already provided.

Privacy Policy

2. Information Derived from the Service

2.1. As part of providing the Service, Servul collects certain information divided into:

2.1.1. User Details;

2.1.2. Service Details (such as call details), service agreements with your service providers, and recording of inquiries with service providers;

2.1.3. Information that Servul receives based on the User's use of the Service (including device details, location information, local storage and Cookie files, and anonymous identifiers).

(hereinafter together: "the Information").

2.2. Servul makes an effort to protect the Information against unauthorized access, unauthorized modification, as well as against disclosure or deletion of the Information.

2.3. Most of the Information is encrypted using SSL.

3. Information Security and Use of Information

3.1. Servul prevents third-party access to User Details and allows access only to employees and contractors of Servul who need the information for Service purposes and who are subject to binding confidentiality obligations.

3.2. The Service allows the User to share information with others. When the User shares information publicly, search engines may include it in their index. Also, the User is aware that if other users of the Service know their email address or if they have other details identifying them, Servul may show them their profile details in Servul, if the User has given consent to that.

3.3. The Service provides the User with options to share and remove content appearing in the User's profile.

3.4. The provisions of section 3.1 shall not apply in the following cases:

3.4.1. If the User authorized Servul to use and/or publish the User Details or information from the User's profile, including recorded inquiry or Supplier agreement (hereinafter: "the Content"); The User declares and undertakes that upon approving the sending of email of the Content or upon agreeing that the Content will be shared publicly, Servul will be entitled to make any use of the Content, including its publication, as it sees fit.

3.4.2. Information that will be transferred to affiliated entities and/or companies and/or individuals who will perform external processing of information transferred by Servul. For the avoidance of doubt, these entities will be subject to Servul's privacy policy and all required confidentiality and security requirements.

3.4.3. Information that Servul will be obligated to disclose according to any law.

3.4.4. If a user has decided at their discretion to allow other users to view, respond, and communicate on any matter related to their content ("social network").

3.5. Servul uses the information collected by it to provide, maintain, improve the Service, to develop new services, and to protect Servul and the users of the Service. The User is aware that Servul will be entitled to collect anonymous information of users of the Service for statistical purposes, and to publish it publicly.

3.6. The User agrees that Servul will use the information to offer you content tailored to your needs.

3.7. The User is aware that Servul may process your User Details on a server located outside your country of residence.

3.8. Servul will request your consent before using information for a purpose not included in this Privacy Policy.

General Terms Regarding the Service

4. Intellectual Property

4.1. It is hereby clarified that all rights in the Service, including copyrights, patent rights, trademark, design, trade secrets, and any other right owned by Servul, as they are today and as they will be in the future, are solely of Servul which will be entitled to act as an owner and the User has no and will have no right in them.

4.2. The User is granted the right to use the Service in accordance with section 1 above. Rights that are not expressly granted to the User under this agreement are not implied, and are the exclusive rights of Servul. Without prejudice to the generality of the above, in relation to the Service and/or any part thereof, the User is not allowed and will refrain from the following:

4.2.1. Taking any action, directly or indirectly, aimed at undermining and/or harming and/or reducing Servul's intellectual property rights in any way.

4.2.2. To make unlawful use of the Service. "Unlawful use" means any use that is not legal and/or constitutes a violation of any law.

5. Limitation of Liability

5.1. The Service is provided to the User "AS IS" and Servul shall not be liable to the User for use of the Service or the proper functioning of the Service. In no case shall Servul be liable to the User or anyone on their behalf for any direct or indirect damage, loss of profits, special damages or compensation including for punitive damages, or any claim or demand submitted related to the Service and/or use of the Service.

5.2. Servul shall not be responsible for the use that the User will make of the Content (as defined above) and any use that the User decides to make with the Content is their sole responsibility.

5.3. Servul shall not be responsible for the proper functioning of the end equipment, and/or its suitability for use in the services, and the User is solely responsible for ensuring that the end equipment conforms to what is required for the provision of the Service.

5.4. Provision of the Service shall be subject to the availability and proper functioning of the Internet networks and cellular networks, and Servul bears no responsibility in this regard.

5.5. Servul shall not be responsible for the content, completeness, reliability, or accuracy of the content transferred within the framework of the Service ("Service Content"). The User agrees and undertakes that they have no and will have no claim or demand against Servul for any loss, damage or direct or indirect loss, which was caused as a result of reliance on the Service Content. The contents included in the Service may contain inaccuracies or typographical errors.

5.6. Servul shall not be responsible for the preservation, proper functioning, or completeness of the recordings documented in the framework of using the Service. For the avoidance of doubt, it will be clarified that the recording services are provided to Servul by an external supplier, and are stored on servers external to Servul.

5.7. Servul operates as an independent supplier and is not connected to the suppliers with whom the User will engage through the Service.

5.8. Servul shall not be responsible for the confidentiality of information and content that will be distributed by users on the social network of the Service and also will not be responsible for messages from users, including their content, which will be distributed through the social network.

6. Indemnification

The User undertakes to indemnify and compensate Servul for all costs and expenses associated with the above, including attorney's fees, which Servul will be required to bear or will be responsible for, or will need to pay for, insofar as it results from an actual or alleged claim, based in whole or in part on a breach made by the User or any of their employees, or agents or anyone on their behalf of the requirements of this agreement.

7. General Provisions

7.1. In any lawsuit related to or arising from this agreement, and/or the Service, exclusive and sole jurisdiction shall be given to the competent court in Tel Aviv only.

7.2. The law applicable to this agreement, including the manner of its execution and the interpretation of its provisions, is the law of the State of Israel only, except for provisions regarding choice of law.

7.3. Any notice that Servul sends to the User to the address provided to it, shall be considered as if it reached its destination three business days from the date of its sending if sent by mail or email, and if delivered by hand or transferred by facsimile – upon receipt of confirmation of its delivery or transfer.

7.4. The Privacy Policy and General Terms detailed above may change from time to time. Servul will not reduce the User's rights provided within the Privacy Policy and General Terms without the User's prior consent. Servul will publish changes to the Privacy Policy and General Terms on this page, and if the changes are significant, a more prominent notice will be published.

7.5. Servul shall be entitled, at its sole discretion, to terminate, restrict or suspend the User's use of the Service for any reason.
